Tennessee Code 39-13-102: What Qualifies as Aggravated Assault

Aggravated assault is defined under Tennessee Code Annotated 39-13-102. The statute elevates what would otherwise be simple assault into a felony based on specific aggravating factors: the assault causes serious bodily injury, involves the use or display of a deadly weapon, or involves strangulation or attempted strangulation.

Serious bodily injury means more than a bruise or minor cut. Under Tennessee Code Annotated 39-11-106, it covers injuries involving a substantial risk of death, protracted unconsciousness, extreme physical pain, protracted or obvious disfigurement, or protracted loss or substantial impairment of a bodily function. A deadly weapon is any object designed to cause death or serious bodily injury, including a firearm, though an ordinary object can also qualify depending on how it’s used.

The statute also reaches two less obvious situations. A person who violates a restraining order or order of protection by committing what would otherwise be simple assault can face an aggravated assault charge. A parent or custodian who knowingly fails to protect a child or vulnerable adult from an aggravated assault can be charged under the same statute.

Simple assault under Tennessee Code Annotated 39-13-101 covers three types of conduct: intentionally or knowingly causing bodily injury, causing a reasonable fear of imminent bodily injury, or making physical contact a reasonable person would find extremely offensive. Simple assault is generally classified as a Class A or Class B misdemeanor.

Aggravated assault elevates the charge to a felony because of factors not present in a simple assault: serious injury, use of a weapon, or strangulation. Aggravated assault in Tennessee is charged as either a Class C felony or a Class D felony, depending on the circumstances of the offense.

• Class D felony: Carries a prison sentence ranging from 2 to 12 years, plus fines up to $15,000.

If the victim is pregnant at the time of certain offenses under the statute, the charge can rise to a Class B felony. A felony conviction also removes the right to own or possess firearms under Tennessee law. These are general statutory ranges.
