What is Judicial Diversion in TN?
In the state of Tennessee, there are two different types of diversion: pre-trial and judicial diversion. The judicial diversion is effectively a conditional guilty plea. If granted, you plead guilty, but the case is dismissed and the court does not find you guilty, if you conform to the terms of your probation.
Violating the terms set down for you by the court can result in a revocation of your diversion, at which time your guilty plea will be accepted and sentencing will commence. However, if you do comply with all probationary measures, you are given the opportunity to maintain a clean criminal record.
There are three main eligibility requirements to be granted diversion. You must:
- Have not been granted diversion previously
- Have no felony convictions, or misdemeanor convictions for which you served a jail sentence
- Request the appropriate type of diversion for the offense with which you have been charged
